This Website www.catchdataservices.com is owned and operated by Catch a division of Reed Business Information Pty Limited, and the data that is extracted is made available on the following terms and conditions. By using the Site and data you agree to be bound by these terms and conditions and will not use the Site or data for any purpose or in any way which is illegal or which contravenes these terms and conditions.
At any time and without notice Catch may vary these terms and conditions and make alterations to or withdraw the Site or any part of it.
In these terms and conditions, Catch Data Services is the ‘List Owner’, the expression ‘List User’ includes a body whether corporate, public or otherwise or any other entity that is renting contact data (Postal or Email) via the Catch Data Services website.
Email List Rental
The List User acknowledges that the Data supplied pursuant to this Agreement is provided for the use of the List User subject to and on the following terms and conditions:
- The Data is and remains the property of the List Owner, Catch Data Services.
- The Email User agrees that the email is to only be used once for one campaign; as described, and between dates shown above.
- Email names may be rented for promotional purposes only. All promotional campaigns are subject to approval by CDS. A sample email is required prior to broadcast of campaign.
- Catch Data Services cannot provide any guarantee on deliverability of email.
- You may cancel this agreement at any time prior to Catch data Services fulfilling this order
- Email names cannot be sent directly to the client. Catch data Services will broadcast the campaign on the list user’s behalf. Email will not go out without list users’ approval, test email will be sent prior to broadcast. Full tracking report of campaign will be provided.
- Catch data Services will not pass on, provide, or disclose the Data to any party other than those described as Data Processing Parties above.
Postal List Rental
The List User acknowledges that the Data supplied pursuant to this Agreement is provided for the use of the List User subject to and on the following terms and conditions:
- The Data is and remains the property of the List Owner, Catch Data Services (CDS).
- The List User agrees that the Data is to only be used once for one campaign; as described, and between dates shown above. The Data shall be destroyed within 5 days of processing/use.
- Data may be rented for promotional purposes only. All promotional campaigns are subject to approval by CDS. A sample mailing piece is required prior to each order being processed.
- You may cancel this agreement at any time prior to Catch Data Services fulfilling this order. However if this agreement is cancelled after the order has been fulfilled, a $500.00 cancellation fee will automatically apply.
- The List User agrees that Catch Data Services has only agreed to supply the Data to the Data Processing Parties described above and the List User will not supply the data to other parties without first obtaining written permission from Catch Data Services. The List User will at all times be accountable for the security and whereabouts of the data.
- Catch Data Services will not pass on, provide, or disclose the Data to any party other than those described as Data Processing Parties above.
- The List User will not make, produce, or keep any copies, duplicates or extracts (electronic, hardcopy, or otherwise) of the Data (other than details of new “customers” that have been obtained from the single authorised campaign) for its ongoing use. The List User agrees that if the Data is to be used on an ongoing basis, then an arrangement with Catch Data Services will have to be made. The List User will not enhance the Data in order to obtain ongoing use of the Data.
- No enhancement of any other list or database by use of the Data is permissible. No creation of any list or database by use of the data is permissible.
- The Data is individually “seeded” with fictitious contacts (“Seeds”) so that Catch Data Services can monitor usage of the Data and identify misuse. These seeds are added to the total quantity ordered.
- A “Misuse” of the data shall be deemed to have taken place when any one or more of the Seeds in the Data is re-mailed or contacted without authorisation from Catch Data Services or if any other term or condition of this agreement, or any related agreements, pursuant to this agreement, is breached by the List User.
- If a Misuse takes place without written permission from Catch Data Services, the List User will immediately pay to Catch Data Services the full rental price of the Data and may be subject to legal action.
- The full rental price of the Data + GST (excluding discounts and commissions) shall be paid by the List User for each and every unauthorised use of the Data and the List User shall indemnify Catch Data Services against all losses or expenses, including legal costs, incurred as a result of the List User’s breach of this agreement.
- Any unauthorised use of the Data, as well as being a breach of this agreement, will constitute a breach of the Copyright Act 1968 (Cth) rendering the List User, and officers of the List User, subject to all remedies provided by the Copyright Act including preliminary and permanent injunctive relief, compensatory damages and/or an account of profits.
- Governing Law and Jurisdiction: This Agreement is governed by the law of New South Wales and the parties agree to submit disputes arising out of or in connection with this Agreement to the non-exclusive jurisdiction of the New South Wales Courts.
